Conflicto de competencia presentado entre el Juzgado Segundo Civil Municipal Florencia y el Juzgado Primero Civil Municipal de Popayán.
La controversia entre los precitados despachos de fundó en las diferentes interpretaciones del factor territorial.
Ambas autoridades presentaron una serie de argumentos relacionados con el lugar donde se presentó y tuvo sus efectos la vulneración de derechos alegada.
Se resuelve el asunto con la remisión del expediente al Juzgado Segundo Civil Municipal Florencia para que, de manera inmediata, tramite y adopte la decisión de fondo a que haya lugar.
Al otro operador jurídico se le advierte que, cuando considere que existe un conflicto de competencia en materia de tutela, este debe ser resuelto por las autoridades establecidas en la Ley 270 de 1996 y el Auto 550/18.
